Kent County Traffic Court System

Kent County sits at the center of Delaware, and Dover serves as both the county seat and the state capital. The county's court system handles a wide range of cases, from minor traffic citations to serious criminal matters. For traffic violations, most cases begin in the Justice of the Peace Courts, which have limited jurisdiction over non-felony offenses. More serious cases, including certain misdemeanors and appeals from lower court decisions, move to the Court of Common Pleas at 414 Federal Street in Dover.

The Superior Court also operates out of the Federal Street courthouse and handles felonies, major civil cases, and appeals from the Court of Common Pleas. The Court of Chancery covers business disputes and equity matters. Each court keeps its own set of records, and access rules can differ depending on where a case was heard. Knowing which court handled your case is the first step before you search.

Traffic violations in Kent County fall under Delaware Code Title 21, which governs all motor vehicle offenses across the state. Courts must report convictions to the Division of Motor Vehicles within 30 days of a final judgment. That reporting requirement means your driving record can reflect a Kent County court outcome fairly quickly after a case closes.

Note: Cases from Harrington and surrounding communities may be heard at Court 7 in Dover or another Kent County JP Court location, depending on where the violation occurred.

Justice of the Peace Court 7 Traffic Records

JP Court 7 in Dover is one of only two Justice of the Peace Courts in Delaware that operates around the clock, every day of the year. The other is Court 3 in Georgetown. This 24-hour schedule reflects Dover's role as the state capital and the volume of traffic through central Delaware. Court 7 handles traffic violations, misdemeanors, and other criminal matters for Dover and the surrounding Kent County area.

The JP Courts have exclusive jurisdiction over certain non-felony traffic cases. They also handle preliminary hearings in felony matters and civil claims under $15,000. When a driver receives a citation in Kent County, the case is typically filed in the JP Court located in the county where the violation occurred. That means most Kent County traffic citations end up in Court 7 or another local JP Court. Records from these courts are separate from Superior Court or CCP records and must be requested directly from the JP Court where the case was filed.

Speed violations carry per-mile fines under Title 21, Chapter 41, Subchapter VIII. Reckless driving is addressed in Subchapter IX of the same chapter. DUI offenses follow a tiered penalty structure: a first offense is a misdemeanor with fines up to $1,500 and up to 12 months in jail, while a third offense escalates to a Class G felony.

The official JP Court page at courts.delaware.gov/jpcourt provides contact information for Court 7 and explains how to submit records requests. You can reach the court by mail, fax, or in person during operating hours.

Court of Common Pleas Kent County Records

The Court of Common Pleas serves as a mid-level trial court in Delaware and handles most misdemeanor cases, preliminary hearings in felony matters, and civil claims under $50,000. It also hears appeals from JP Court decisions. For traffic-related matters, the CCP becomes relevant when a driver appeals a JP Court ruling or when the case involves a charge that exceeds JP Court jurisdiction. The Kent County CCP shares the 414 Federal Street address with the Superior Court.

You can reach the Court of Common Pleas at (302) 735-3900. Public access terminals are available at the courthouse for anyone who wants to search case records in person. Staff can help you identify the right case number or point you to the correct court if you are unsure where a case was filed. Call ahead before visiting, as terminal availability and hours may vary.

Note: Appeals from JP Court to the Court of Common Pleas must be filed within 15 days of the JP Court judgment; late filings may be dismissed without review.

There are three main ways to search Kent County traffic court records: online through CourtConnect, in person at the courthouse, or by written request to the JP Court. Each method reaches a slightly different set of records, so the right approach depends on which court handled your case.

CourtConnect at courtconnect.courts.delaware.gov is free and available 24 hours a day. You can search by name, case type, or case number. Results include docket entries, party information, case status, and judgments. This tool is the fastest way to look up a Kent County traffic case without making a trip to Dover. Most Superior Court, CCP, and JP Court cases appear in the system, though some older records may not be indexed online.

The CourtConnect search portal is shown here. Visit courtconnect.courts.delaware.gov to search Kent County court records by name or case number at no cost.

For in-person searches, the Kent County Courthouse is at 414 Federal Street, Dover, DE 19901. The Superior Court main line is (302) 735-1900. Public terminals are on site. If you want a staff member to pull records or make copies, bring any identifying information you have about the case, including the defendant's name, approximate case date, and case number if known. Full payment is required before copies are released.

For JP Court records that are not available online, contact the JP Court location where the case was filed. Written requests can be sent by mail, submitted in person, or sent by fax. Drivers who want to pay a citation online can use the ePayment portal at pubsrv.deljis.delaware.gov. The Voluntary Assessment Center at 480 Bank Lane, Dover, DE 19904 handles voluntary payments for eligible citations; their phone number is (302) 739-6911. Under Title 21, Chapter 709, drivers have 30 days from the citation date to pay through the voluntary assessment process.

Kent County Public Access Policy for Court Records

Kent County operates under Policy 25, which governs public access to records held by county departments. The policy sets clear rules about when and how residents can examine public records. Under Policy 25, public records are open for inspection during regular business hours. Records that are actively in use by staff may not be immediately available, and you may need to schedule an appointment to view them.

The Kent County public access policy framework is shown below. Visit the official policy page at ecode360.com for the full text of Kent County's public records access rules.

Kent County public access policy for traffic court records

Policy 25 outlines when Kent County court records are open for public review and what steps residents must follow to get copies of documents.

Original records must be supervised by the department manager or custodian responsible for that set of documents. You cannot remove original records from the office. Full payment is required before copies are delivered to you. The policy applies broadly to county-held records; court records maintained directly by state courts may follow separate Delaware court rules rather than Policy 25.

Note: Court records held by state courts in Kent County follow Delaware Supreme Court rules on public access, not Kent County Policy 25, which covers county department records only.
