New Castle County Traffic Court System

Traffic court records here are not held in a single place. They are spread across Justice of the Peace Courts, the Court of Common Pleas, and two Alderman's Courts depending on where and how the violation occurred. The Justice of the Peace Courts handle the bulk of traffic court records in New Castle County. These courts process motor vehicle violations, minor criminal charges, and civil disputes under a set dollar limit. They operate as courts not of record under 10 Del. C. ยง 1301, which means proceedings are not transcribed word for word. Audio recordings are kept instead. That distinction matters a lot when you need to appeal. The JP Court locations in New Castle County cover a wide geographic range. JP Court 9 serves the Middletown area and handles both criminal and civil matters, making it one of the busier courts outside Wilmington. JP Courts 11 and 13 share a building in New Castle and split between criminal and civil dockets respectively. JP Court 20 is inside the Wilmington Public Safety Building, which means it handles high-volume criminal traffic matters from the city's core.

Court of Common Pleas Traffic Records

This court hears traffic cases on Tuesdays. If you are appealing a JP Court traffic conviction or if your case was referred up from a lower court, this is where it goes. Schedules can shift, so call ahead before you show up for a hearing.

The Court of Common Pleas has broader jurisdiction than the JP Courts. It handles misdemeanor criminal cases, appeals from courts not of record, and traffic cases that involve more serious charges or where the defendant has requested a new trial after a JP Court decision. Because the court is a court of record, proceedings here are transcribed. That means getting a copy of a court filing from a CCP case is more straightforward than from a JP Court case. Alderman's Courts in New Castle County

New Castle County has two Alderman's Courts. Court 40 is in Newark. Court 42 covers Delaware City, with another court in Newport. These are local municipal courts with limited authority. They can handle parking violations, traffic violations, disorderly conduct, and minor misdemeanors that occur within the city limits of those municipalities. They cannot hear cases from other jurisdictions.

Like the JP Courts, Alderman's Courts are designated courts not of record. There are no verbatim transcripts. Appeals from an Alderman's Court must be filed within 15 days and go to the Court of Common Pleas, where the case starts fresh. One important rule: if you get a moving traffic violation conviction in an Alderman's Court, the court must send notice to the Delaware Division of Motor Vehicles within 10 days. That means points get added to your driving record on a set timeline. You cannot delay that process by waiting to appeal.

Court records from Alderman's Courts are generally held at the municipal level and are not centralized through CourtConnect the same way state court records are. Note: Alderman's Court convictions for moving violations are forwarded to DMV within 10 days. Appeals must be filed within 15 days in Court of Common Pleas.

The primary online tool for New Castle County traffic court records is CourtConnect. You can reach it at courtconnect.courts.delaware.gov. CourtConnect lets you search by person name, business name, or case number. Search results show case details, docket entries, and judgment information. It covers records from the Court of Common Pleas and Superior Court but also pulls in some JP Court data for finalized cases.

CourtConnect is a public access tool. You do not need to register or create an account to run a basic search. Enter a first and last name or a case number and the system returns matching records. For civil cases specifically, the state also offers a dedicated portal at courts.delaware.gov/docket.aspx. The civil docket search is useful when you are looking at cases filed in Court of Common Pleas or Superior Court that involve traffic-related civil claims.

Not every case shows up online. JP Court cases that are still pending or that involve sealed records may not be visible. If you run a search and get no result for a case you know exists, your next step is to contact the specific court directly. Public access terminals are also available inside the Leonard L. Williams Justice Center courthouse. Those terminals let you search records in person. Hours are 8:30 a.m. to 4:30 p.m., Monday through Friday. How to Request Traffic Court Records in New Castle County

The process for getting traffic court records in New Castle County depends on which court handled the case. Each court has its own form, fee schedule, and contact point. Getting the right paperwork up front saves a lot of back-and-forth.

For JP Court records, use MISC Form 35, the Application for Access to Court Records. You can get this form at any JP Court location or from the court's administrative office. Fee schedules for JP Court records are set by state rule. A criminal disposition copy costs $7. A certified copy of a criminal record also costs $7. Civil certified copies run $10. Civil docket pages are $0.25 each. If your case includes audio recordings, a copy on CD costs $25. These fees apply statewide, including all New Castle County JP Courts.

That is one of the few JP Court locations with a published email address for records requests. Other locations typically require you to submit MISC Form 35 by mail or in person.

Certified copies cost $15 for the first three pages, up to $2 for each additional page, and may include a $25 retrieval fee for older or archived documents.
